Reporting Claims of Copyright Infringement
Toast takes claims of copyright infringement seriously. If you believe any materials accessible on Toast’s platforms infringe your copyright, first consider whether any copyright defenses, limitations, or exceptions, such as fair dealing, apply.
In Canada, notices of alleged infringement must be directed to the Internet Service Provider of the allegedly infringing user (an “ISP Notice”), not Toast. Toast is under no obligation to investigate the alleged infringement or to remove the allegedly infringing content.
For further information regarding ISP notices and the mandatory content they must include, please refer to Section 41.25 of the Copyright Act (R.S.C. 1985, c. C-42) and the following guidance from the Government of Canada: https://ised-isde.canada.ca/site/office-consumer-affairs/en/connected-consumer/notices-canadian-internet-subscribers
Importantly, an ISP Notice is distinct from any lawsuit for copyright infringement. An ISP is under no obligation to remove the infringing material upon receipt of a compliant ISP Notice, and the recipient of a notice does not have any obligation to respond to the ISP Notice. If you believe any materials accessible on Toast’s platforms infringe your copyrights, you must secure a court order to seek remedies for copyright infringement (including content takedown). Toast will comply with all valid Canadian court orders regarding content takedown and removal.

Reporting Claims of Trademark Infringement
In Canada, ISPs and other online intermediaries are not required to notify alleged trademark infringers or remove infringing material. If you believe any materials accessible on Toast’s platforms infringe your trademark rights, you must secure a court order to seek remedies for trademark infringement. Toast will comply with all valid Canadian court orders regarding content takedown and removal.
Toast is under no obligation to investigate the alleged infringement or to remove the allegedly infringing content.

Repeat Infringers
Toast’s policy is to terminate the accounts of users who are repeat infringers in appropriate circumstances.
